1. Who we are
The service is operated by Afaq Music, based at Levent Mahallesi, Büyükdere Caddesi No:185, Şişli, Istanbul 34394, Turkey. You can reach us at hello@afaqmusic.online.
2. Accounts
- You must be at least 18 years old, or have the consent of a legal guardian, to create an account.
- You are responsible for the accuracy of your account information and for keeping your credentials secure.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@afaqmusic.online if you suspect unauthorised use.
3. Distribution services
If you use Afaq Music to distribute recordings, the Exclusive Artist Distribution Agreement applies to that relationship in addition to these Terms. In case of conflict, the Distribution Agreement governs the distribution service.
4. Acceptable use
You agree not to:
- Upload content you do not own or are not licensed to distribute.
- Submit content that is defamatory, hateful, illegal, or infringes any third-party rights.
- Engage in or facilitate artificial streams, downloads, chart manipulation, or bot activity.
- Interfere with the service, other users, DSP partners, or the underlying infrastructure.
- Attempt to access data, accounts, or systems you are not authorised to use.
Violations may result in immediate suspension or termination of your account and forfeiture of associated royalties.
5. Fees, refunds & subscriptions
Applicable fees, revenue-share splits, and payout thresholds are set out in your plan or in the Distribution Agreement. Where the service is offered on a subscription basis, subscriptions renew automatically until cancelled from your account settings before the next renewal date. Fees already paid are non-refundable except where required by law, or where we have not begun performing the service. Chargebacks initiated without first contacting support@afaqmusic.online may result in suspension of your account until the dispute is resolved.
6. Intellectual property
All Afaq Music branding, product design, software, and site content are our property or licensed to us. You retain all rights in the music, artwork, and metadata you upload; you grant us the licences described in the Distribution Agreement solely to operate the service.
7. Third-party services
The service integrates with DSPs, payment providers, and other third parties. Their own terms and policies apply to your use of those services. We are not responsible for changes, outages, or decisions made by third parties.
8. Disclaimers
The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or specific commercial outcomes on any DSP or chart.
9. Limitation of liability
To the maximum extent permitted by law, Afaq Music is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability arising out of or in connection with the service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
10. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we reasonably believe your account is involved in fraudulent or harmful activity. You may close your account at any time by contacting support.
11. Changes
We may update these Terms as the product evolves. Material changes will be announced by email or in the dashboard. Continued use of the service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Republic of Turkey. The competent courts of Istanbul, Turkey have exclusive jurisdiction, subject to any mandatory consumer-protection rules applicable where you live.
